The federal appeals court has maintained a prohibition on deploying national guard in the Oregon city, after a latest legal decision.

Judicial Panel Agrees to Rehear Case

The ninth circuit court of appeals ruled on this week that it would reexamine the legal dispute concerning the executive power with an expanded panel of eleven justices. The judicial body also overturned a earlier decision from a three-judge panel that had sided with the federal government.

Legal Saga Over Military Presence

This order represents the latest turn in a long-running legal battle over whether the administration has the legal right and valid reason to deploy state military units in Portland. Approximately 200 federalized guard members have been in uncertainty since the end of September when the deployment effort was started in response to months of protests.

Differing Viewpoints

The administration has argued that government employees at the ICE facility in south Portland were under attack, while city and state officials assert that municipal police have command of the situation.

In defiance of characterizations of Portland as a conflict zone, locals have been posting videos of scenic paths and a vibrant culinary culture, and planning activities such as an Emergency Naked Bike Ride against the increased military presence.

Court Proceedings

The Tuesday ruling came after a US district judge in the city enacted two legal injunctions this month – one blocking the federalization of the state troops, and another prohibiting the deployment of any military personnel in Oregon, after attempts to evade the initial injunction by mobilizing out-of-state forces.

On Monday, the ninth circuit panel had temporarily suspended the initial decision – permitting command of 200 Oregon national guard – but the subsequent injunction stayed effective, preventing the physical sending of the forces.

En Banc Review

The latest ruling means the matter will be heard by the full court – with all decisions under review simultaneously – by a group of 11 judges.

“This decision demonstrates that the truth matters and that the judicial system are working to ensure government responsibility. The founding document limits the president’s power, and Oregon’s communities cannot be treated as a testing site for expansive government power,” stated the legal representative in a official comment.

“The court is sending a clear message: the president cannot dispatch the military into American urban areas without cause. We will continue defending state legislation, principles, and autonomy as this legal proceeding moves forward and our fight continues in the courts.”
